My Green Card is stuck at EB2 Stage but all this time I forgot that I have potential for a British Citizenship based on my birth place and Father being a Britisher.
Now can I reapply as a Brit - all over again hoping to get past the long queue. I am not interested in gaming - dont get me wrong - I had been in UK for some 5-6years working and am easily eligible for to get UK Citizenship that I did not explore. Now can I change the situation ?

I would also suggest that you post messages in all college/university/school cantenes and other such visible places where students gather. I have donated blood many times (>10 times) when a student and I am sure that you will find many students who are willing to help.
I have also helped organize blood donation camps and such when a student. In fact I am was trained volunteer - for whatever value 4 days of classroom training have. I'd suggest that you should avoid the "professional"/"regular" donors - as many of them would be drug addicts and "donate" blood for drug money. Schools and colleges are good places to avoid that crowd and still get a large number of prople willing to donate blood.

After the show down of the USCIS and all the high skilled immigrats. USCIS posted that they are withdrawing the July 2nd board. This is great news.
I have filed my I-485, I-131, and I-765, and they reached USCIS by July 13th. According to the new board, USCIS will no long reject them.
So what will happen from now on? What is the procedure after this?
I guess this might be a newbie question. If someone can post some answers for me, it will be very helpful.

As such, there is no grace period and it starts counting towards unauthorized stay (US is somewhat liberal for unauthorized stay for up to 180 days). It should be fine getting H1B transferred ASAP.
After 180 day, reentry can be banned for three years. After 1 years reentry can be banned for 10 years.

Here is my situation..
I was working for company A and had company A Visa on PP valid untill 2010. Now I came under company B with same job descripton. Company B filed for H1b transfer 2 weeks back for which we have not received LIN number yet.
My questiosn are..
1. Can I visit india while my tranfer is pending...???
2. if I plan to visit india after H1b aproval, do I need to get a new visa stamping for company B or can I travel back with company A visa ..??
3. For me to travel back with company A visa , do I need to make sure company A has not informed USCICS to cancel H1b visa.
Greatly apprecite if you can share your suggestions/expereince on this....

I would appreciate if someone could answer the following question. Before I ask my question, below is a brief background:
- H-1b Date Started: October 2005
- Current H-1b expiration: August 2010 (when I switched my last job in August 2007, they extended for 3 years)
- Date of filing labor: January 10, 2010
- Time outside US on H-1b: about 90 days.
My attorney at work said that I would still need approximately another two months (comfortably) of time outside of the US that they can recapture. This extension would take me into late January 2011, more than one year past the point of the PERM filing. They can, at that point, apply for a 'seventh year' H-1B extension based on my PERM process having been pending for more than one year.
Here is my question. Since I am currently in my fifth year of my h-1b, would it be possible now to apply for the sixth year of h-1b visa until October 2011 instead of looking at seventh year? I started my h-1b in October 2005. Therefore, I have until six years before my h-1b visa can expire, is that correct? If this is not correct, I would appreciate if anyone has any other suggestions to avoid travelling for 2 months out of US prior to July 2010.

Bottom line I was suggested to take infopass.. so I took.. Its my first infopass appt ever and it was very easy... shown me 2 dates avaialable for Aug (nothing in July).. So I pick one and then was asked to pick a time...
I selected as a follow up on pending case...
Hopefully they'll process my AOS before that :-)

USCIS has already enacted a regulation that allows the Service Centers to issue multiple-year EAD. However, this regulation has not been implemented by the USCIS because of its impact on the USCIS revenue. The Ombudsman wrote on March 20, 2006 his recommendation to Dr. Emilio Gonzalez, Director of USCIS to implement this regulation on the ground that multiple-year EADs would substantially reduce the USCIS immigration benefits workloads and that if impact on the revenue was the hangup for the failure to implement the published regulation which is a binding rule, the USCIS might consider raising the EAD application filing fees. Multiple-year EAD will relieve the customers from substantial inconvenience and hassle each year. The statistics also strongly support the Ombudsman's statement that issuance of multiple-year EAD would reduce substantially the USCIS workload. For instance, the February 2006 monthly immigration statistical report indicates that the total receipts of entire applications and petitions numbered 409,893, out of which EAD applications numbered 100,051, during one month in January 2006. It means one-fourth of total immigrantion benefits applications and petitions were taken by the EAD applications! This reporter strongly and without any reservations supports the Ombudsman's recommendation and justification! This reporter urges Dr. Gonzalez to implement the regulation as soon as possible.
The CIS Ombudsman also recommends the USCIS to issue EAD valid as of the date of the current EAD expiration rather than the date of approval. Current practice has raised pains and aches to the I-485 waiters in two areas: Potential gap between the date of expiration of current EAD and the date of approval of extension of EAD, and loss of some period of existing EAD when the EAD renewal is issued a few months earlier than the expiration date of the current EAD. I'd do the reverse. I am currently working on EAD so I dont want any issues with being without an EAD for even a day. I'd apply exactly at the 120 day mark. Even if I lose some valdity, its ok.
As far as AP is concerned, I dont mind if it comes a bit later or even after the previous one has expired.
3-4 days. These days they are fast on approvals. Best thing is to apply AP within 120 days range and apply EAD when 100 days away from expiry. Atleast you will get 2 years EAD and dont need to pay again.

Hello,
Here's my situation. I have an approved I-140 (EB2), my I-485 has been pending for more than an year. Due to recent lay-offs, I will have to change my employer through an H-1B transfer. My wife was on H-4. However, just this year she got an H-1B approval with consular processing since when we applied for her H-1b this year, she was not in US.
Now 2 weeks back, her employer applied for her COS through regular processing. I assume this takes about 3-4 months.
My question is - now that I am doing my H-1B transfer to another employer, do I have to worry about my wife's H-4 extension as well, or just leave that as it is, as her application for COS to H-1B is pending with USCIS.
Please advise.

In my opinion, leave it as it is.
also, please spend few minutes to send out 4 letters in support of fight against cases using AC21 and getting denials without any reasons. You might very well fall in this if you plan/have to use your EAD.

uscis sent incorrect alien registration # with my name to fbi for name check which ended up in an error . now after waiting for 2 years and 4 months uscis tells me that they are going to assign me a new alien # and send name check all over again. i am stuck please help..what options do i have to expedite this as it was uscis error.

90% people who apply for 485 are lucky to not face this.
There are just so many issues we face in our immigration process and cause us pain. Our efforts in the upcoming immigration debate will help this issue. There are provisions like doing the entire 485 processing within 6 months we need to protect. Please join us and support us so that we can all get rid of our immigration sufferings.

My birth certificate does not have my name on it. (in india it is OK to name the new born a few weeks after birth.) so it just says "baby boy" on it:)

H1 would be valid/active the moment you accept employment with H1-B sponsoring employer.
Since you haven't started working and assuming you haven't accepted the offer from the
H1 sponsoring employer, YOU should be fine.
Please take advise from your company attorney.
