So step children get the same benefits as dependants. Good to know. I guess if it wasnt so, someone would have raised some issue about it by now. Atleast there would have been a bill in congress.

I got my GC approved for me and son (I485 application) in Nov 2007. I got my gc, whereas for my son who is 7 year old though he got I485 approved yet he did not get his GC. They mentioned they might need his finger print and so far no response from them. This is despite several follow up with them.
Last year 7 months he was not in US and now can he go to India and he will be there rest of this year.
Will it affect his GC and when will he get his GC?

According to my knowledge the majority of name checks submitted are electronically checked and returned to the submitting agency as having "No Record" within 48-72 hours. The processing time for FBI name checks usually take from 30-120 days but timing does vary from case to case. The FBI�s intention is to have all visa requests processed within 120 days. Most name check requests that are over 60 days old are the result of the time required to retrieve and review field office record information. Any case which is not processed within this time frame is usually delayed because of a potential "hit" which will be further reviewed manually.

You can apply for an MTR, and if it is approved, you are safe. If not, you will be out of status from the day your petition was denied.
You can apply for H1 with another employer and have it premium processed.

Hi Old Monk and GC.....Thank you for your reply. I am canadian citizen by naturalization. Is it a fast process for naturalization (not by birth) Canadian Citizen too? I havn't applied for I-765. As right now, my husband has no intention me to work in USA. Suppose in future if I decide to work...Can I work once my GC will approve, or do I have to have file I-765 to get permission to work?
Its been only one week, since I have mailed my I-485 to Chicago office. I havn't got my reciept yet. So,will wait for another week or so. As someone said on this forum usually it takes 10 days to get the receipt. My question is once I get my receipt can I apply for Social Security and Driving Licence? Can I leave the country to visit my family back home too? Or do I have to wait untill I get my Permanent residence card? As per GC or lets hope for canadian citizen it takes 6-9 months to approve their case. TIA.

The court is saying that since this is a non-binding memo; the court does not need to judge whether or not the USCIS definition of an employer employee relationship is valid or not.
It just means that H1B petitions that have denied based on the 'control' issue can be appealed presumably. But this might only be an option for large IT companies; which is probably what the USCIS knew and planned for all along. I think the goal of the USCIS is to apply this memo selectively against the smaller Desi consultancies.

Hi,
The last time I came back into this country, I used my AP as I didn't have my H1 stamped. My H1 is valid till 2010.
My EAD expired last month and my bumbling lawyer did not send in the I-485 copy and hence there was an RFE. So I still do not have an EAD approval.
Would it be safe to get paid this month or should I have my company process this month's salary after I get my EAD approved?
