I have heard from one of the forums here that an estimated 500K people will file this month since all PDs are current. EB-3 mexico + phillipines togther alone will be close to 300K. God help the Job market.
Also minimum wait time will be 500K/140K ~ 4 yrs before they get to process your GC. Add to that the time for namecheck backlog 2+ yrs. So total 6+ yrs before getting GC........

Based on what Zoe Lofgren said in the video interview it is clear that no piece meal changes will be entertained. Courtesy of the media (read: Lou Dobbs) and the hispanic representation in the Congress/Senate any legal immigration effort is held at gun-point. In my opinion all changes will be rolled up into CIR, which may pass as late as 2010. Be it Obama or McCain, they have bigger issues to address before worrrying about immigration and that to legal immigration. Both have to live up to poll promises and immigration reform features only as a lip-service when both speak on the campaign trail. Bringing the troops home, addressing issues with economy, and solving the energy needs will be prioririty number one for the new President.
I spent considerable time reading the last CIR proposal and it was clearly in favor of illegal immigrants. Restrictions on hiring legal immigrants and choking their talent featured at the top of the "to do" list for legal immigrants like us. I dont see much change in the next CIR. Few changes here or there but the word "Comprehensive" in CIR is reserved for illegals.
Who is to blame? In my opinion, US. Not U.S but us (we the people). On one hand you observe legal hispanic immigrants and business fighting for the cause of their community and on the other we conveniently forget our community as soon as we adopt this alien land. I live in the Bay Area and boy have I seen the marathi mandals, kannada sanghas, TANA, AATA, BATA and God knows how may orgranizations that represent our fractured presence in this country. We have shamelessly displayed our differences based on cultural backgrounds/needs. Sardar Patel's dream of "Ek akhand bharat" (one united India) seems to reverberate only when India plays Pakistan in a game of cricket. I wonder if people such as Vinod Khosla, Vinod Dham, Arun Netravali, Indra Nooyi understand or are are atleast cognizant of the issues their community is facing. For a wild second, imagine the above four making a few phone calls. I bet the impact will be huge.
Congratulating ourselves for small achievements and patting each other the back for things such as two year EAD extension, etc is great but the celebrations have to stop and we need to focus on CIR. Immigrationvoice is a great organization and I will not take away anything from it. That said, collecting a few hundred thousand, making phone calls, and sending flowers is going to do jack-shit. We need representation on the corridors of power. That's where the battle is.
Finally anybody who calls the D.C rally a success needs to go easy on the weed. I was there and I can tell you, it was pathetic. Compare that to the L.A rally by the hispanic community. We can give a million explanations on why the D.C rally was under-represented. The bottomline my friends is that the L.A illegal rally got more coverage on CNN and the media, which clearly translated into a biased CIR.

what is that single document that will define legal status of a person?
visa stamp is what ppl presume..is indicative of status..we all know that it is not.
I 94..to some extent unless you changed status to H1 from F1 and did not go for H1 stamping..then you have to show the I 797 approval form..now..where will this madness stop
now how can a cop understand and verify all of this crap..and anyway..they give out licenses to only legal residents.

Hi All FP seekers! I do not know what exactly I am missing if there is a delay in FP. It looks like hundreds of IV members are too much worried because of the 'delay' in FP. Let me worry too (by knowing the big problem!). Can any worriers explain??

If we will get EADs, let's see who are gonna be our friends and enemies:
Lawyers. They are never our friends. If you are on H1b, then you better do every extension through the lawyer. If your H1b extension will be denied, you are in trouble. If you are on AOS/EAD cycle - you don't need a lawyer. It's a simple application. If for some reason your EAD denied (because you screwed something up in application), you will just reapply - it will not affect your status. If you will have a gap - just take leave without pay, to be formally compliant. So.. lawyers will lose, if we will all jump on EAD.
Employers. Believe me, so many consulting companies will be out of business for good, because a lot of folks will just join other companies for better salaries. It will be no more slavery, no more intimidation. For a lot of employers "f$%4 off" will be the usual thing they hear. So they won't like it.
Average American. We will be able to compete with them directly and kick them out of many positions. It's a capitalist country, and competition is a key to prosperity. It is much harder to find a job on H1B than with EAD. Yes, average American employee is undereducated and overpriced, and with a lot of demand and drama. Successful companies will love to hire us.
US government. They will like to get us on EAD, because we will start having higher salaries and will be paying higher taxes. We will start paying yearly EAD/AP fees. So, in this case DOS is on our side.

Secondly, the current mess we are in was caused by the "sub prime" mortgage loans. If you know what "sub prime" means, then you probably know the areas where these houses were purchased. Have you seen the neighborhoods or the areas where these houses are foreclosed? A majority of us won't even drive through there, leave alone buying houses there. So obviously, us buying homes is not going to solve this economic mess. If you still insist, then you perhaps need to take a class on economics 101.

You need to submit a new education evaluation.
I had also received an RFE.
An acceptable evaluation must:
1) consider formal eduction only
2) state if collegiate eduction is post-secondary education (i.e did appicant complete the US equivalant high school before entering college)
3) provide detailed explanation of material provided
For EB2 degree.. even if your labor states only Masters degree is required you need to prove that minimum education required for master's degree is Bachelors degree and a minimum requirement for Bachelors degree is your 10 + 2 high school education. Please contact thedegreepeople.com (sheila), they helped me in getting my I-140 approved.

but even with this big announcement tomorrow, we still only have 140,000 visas and keep in mind USCIS has just been averaging about 100,000 per year. (so about 40,000 get wasted every year)

You can "tolerate" someone you don't like, but you can not "welcome" someone whom you don't like. I for one, donlt want to be in the "tolerated" category.
And may I ask, what exactly is your definition of hostility? Being chased down the street by a bunch of thugs, who think you should be in their country, or the kind of passive hostility being practised as of now?
Quite honestly, if that is how you feel - perhaps you'd need to reconsider relocating to your home nation. I'm Indian, who grew up in the Middle East. I've lived in the United States for 6 years. I've always felt quite welcome and accepted in every way possible. I believe I've been treated fairly and have had the opportunity to live with Americans and contribute in positive ways. I continue to live here, primarily based on these sentiments. I'd never live here if I felt the way you do now.

I guess the term "YMMV" (your mileage may vary) holds good for this thread...some have had good experiences and some have had really bad ones with Indian and foreign consulates.
But, it is dis-heartening to know the plight of some of the members who had to run from pillar-to-post to get their Indian passport renewed (as the Indian Embassy/Consulates are supposed to help their citizens - not make the citizens' lives miserable).

The reality is, in washington there are two things that open the door of a lawmakers office to a lobbyist:
- a check from the PAC aligned with his cause
- evidence that he represents measurable share of voting citizens in the home district of the representative or senator
And do you see the problem here?
You guys can't legally contribute to political campaigns and you don't represent voting citizens. So, having a lobbyist might be a first step, but it doesn't mean that your cause will be heard.

How about trying the old fashioned way of making the lawmakers aware of the situation of legal immigrants. The fact of the matter is the lawmakers do NOT know about our plight. If you read another post in this forum by the CA team that visited Sen. Dianne Feinstein's office, it came out very loud and clear! They had no clue about our plight. Our main ally in the immigration arena is the US chamber of commerce. They are spending considerable money on advocating for employment based immigration reform (their main thrust however is getting access to unskilled workers, either through a guest worker program or through legalization. in a secondary way they are interested in higher H1b quotas to get access to cheap professionals, fixing retrogression is not very high on their agenda). Have you talked to other organizations classically on our side yet ?
What makes Hadron think that what he believes (that US chamber of commerce is our main ally) is gospel? In case he does not know, there are many other orgs that have a similar agenda. We have made significant progress in establishing relations with many of these orgs. Unfortunately, we cannot reveal everything here. There is more to it than meets the eye! Thats where QGA is helping us immensely

Immigration bills get introduced by the dozen every year, most of them don't even make it into committee (but every time one gets introduced, people here on this board get all excited that finally 'relief is here'.) Even if a coalition of influential senators picks up the issue, there is no guarantee that it will go anywhere.
True, but how often do you see rallies across the country either pro or anti immigrants? How often do you hear about immigration being a hot issue and being discussed on CNN/Fox everyday? How often does the President address it in his State of the Union address? The fact of the matter is that this issue is really hot right now. Do not forget that this is an election year. A lot of the reps hoping to get reelected from border states like TX.AZ etc had promised their constituents that they will tackle immigration reforms. If they do nothing, they will face the wrath!
If there was ever a chance of an immigration bill passing, it is now. If that does not happen, forget about any chance of any immigration related stuff happening in the next 5 years. The question we need to ask ourselves right now is, 'Am I going to TRY to do something this time or should I try it after 5 years'. I know my answer is NOW. But if you want to be pessimistic and think that no bill might get passed, you are in the wrong place. You are better off visiting murthy.com and hope that she announces rapid movement of dates. the primary reason we are all converging here is because we believe that something will happen to the immigration bill and we want to make sure we are not forgotten

I am not angry at anyone, and I don't think that any of my posts can be misconstrued to convey that impression.
I think it is a good idea to start (another) lobbying organization for immigrant rights as the existing ones have a interests very different from us. All the latino groups are only interested in family immigration and legalization of illegals, employment based immigration is only a little blip on their radar screen. Industry on the other hand has their own agenda, again not one coinciding with our issues.
I just think that some of the people involved in IV.com are taking step2 before they have taken step1. They have a nice website (no big suprise with a project run by IT professionals) and are already soliciting contributions, but some aspects of it make me wonder about the level of professionalism involved.
Just to clarify, we are all people with daily jobs other than Immigration Voice. This is a volunteer organization. Do not expect a macromedia flash welcome screen.
So as apparently some of the founders of this organization are present on this board, I would like the following questions answered:
- what is the legal form of your non-profit organization ?
Its on our home page, but just in case, we have applied for 501 C4 status
- is this entity registered in any state, if yes in which ?

- who is registered as the owner of the organizations bank account ?
It is owned by Immigration Voice. Remember, this is a NON Profit organization. It cannot be 'owned' by a person. Again this is on the web site..
- what is the structure of the organization ? Do you have dues paying members, is there a board of directors, trustees ??
Yes....if you know about 501 C4 orgs, they all NEED to have an org structure and there are officers and a board of trustees
- who are the officers of the organization ?
Everything is in place. 501 C4 cannot be registered without that.
For anyone intending to 'vote with their wallet', please keep the following in mind:
- Only US citizens are allowed to contribute to political campaigns (it is even illegal to give money to a citizen friend and have him contribute as a straw-man)
- there are regulations regarding political action committees (PAC) controlled by 'agents of a foreign power'
We are well aware of this and WILL not be contributing to any political campaign. And in any case, where does contributing to political campaign come in the picture? We are just trying to get ourselves heard! Is that illegal in this 'free' country too?
While I appreciate the enthusiasm of the folks setting up IV.com (and I have no reason to doubt the sincerity and honesty of their efforts), I don't see a whole lot on the groups website dealing with the legal aspects noted above.

A lot of foreign governments and entities legally employ lobbyists in Washington. They are merely getting your voice heard by the people's representatives!

Correct, and they are very careful to be registered with the secretary of state as a PAC or public interest lobbying organization. As you point out I am certainly not an expert on the law in this area, but before you start collecting a lot of money, make sure you have competent advice from someone who is (I looked into registering an immigration related PAC a year ago, after realizing the red-tape and political minefields involved I decided not to do so).
We are again beating around the bush here. As I have mentioned earlier, we are registering ourselves as a 501C4 org and are not a Political Action Committee from any angle. Hence the red-tape etc that hadron is talking about is not applicable here at all

I actually don't know how to do that.
The reality is, in washington there are two things that open the door of a lawmakers office to a lobbyist:
- a check from the PAC aligned with his cause
- evidence that he represents measurable share of voting citizens in the home district of the representative or senator
And do you see the problem here?
You guys can't legally contribute to political campaigns and you don't represent voting citizens. So, having a lobbyist might be a first step, but it doesn't mean that your cause will be heard.
Hadron seems to have a very myopic view for everything. Anything and everything for him leads to a political contributions. How about trying the old fashioned way of making the lawmakers aware of the situation of legal immigrants. I don't know whether he has ever seen a reply to a fax from any senator/rep, but all of these misconstrue our request as being either a) A request to increase H1b quota or b) Give amnesty to illegal immigrants. The fact of the matter is the lawmakers do NOT know about our plight. If you read another post in this forum by the CA team that visited Sen. Dianne Feinstein's office, it came out very loud and clear! They had no clue about our plight. This coming from a senator who handles all the high tech firms in Silicon Valley with thousands of legal alien constituents!
