The file is an old policy change where USCIS doesn't automatically consider an pending mandamus lawsuit in court as a reason to expedite. They started fighting these cases but have definitely expedited name checks after the policy change( in 02/2007) in response to court orders.

Hi,
I followed up two more cases with the same status as mine,
All the 3 SR's opened in TSC on 10/14/2009 or 10/15/2009 and answered by the same representative.
Today one of them took an info pass and talked to IO. they said the information could be wrong as they don't see any status like that. and one more thing their case is pre approved.

Many here are getting confused between PPF ( public providend fund) and CPF in India. CPF is a company specific like 401 K. When you leave or resign, you transfer the money to your new employer or leave it back with the old company and the interest rate given is according to the RBI prevailing interest rate. You do not have to deal with any agency other than your employer to manipulate this money.
PPF is for self employed and well for salaried people and this account can be created in a Post Office or a State Bank of India District Office. I have had accounts in PPF and CPF and never had to pay a rupee to get any of that money or to draw a loan..!
Growing economies have their own set of challenges, so please do not trash the system if you faced challenges in the past, things are changing fast and changing for the good in the developing world. Remember what a nightmare it was to get your railway reservation done? Now , I buy my rail as well as air line tickets sitting right here in USA while I plan my trip.
Now coming back to the point of Social Secuirty, you might refer to the agreements that US has with countries like UK where the actual money contributed to the retirement fund does not get trasferred but credit is given in one's own country for retirement benefits and the final fund transfer takes place between the goverments at the end of the year based on a formula ( This forumla is adjusted based on various economic factors). It works both ways for UK and US citizens as there is a great deal of personnel working cross country.
If things go ahead with India on this issue, it would be interesting to watch the options that would be considered as Indian Govt does not any defined 'benefit retirement' plan which could reciprocate the retirement benefit for US citizens working in India. Goverments get interested in these kind of reciprocatory credit programs either based on political or economic reasons. If US is anticipating that the number of US Citizens going to India for work will increase at the same rate as the Indians in USA, they would be interested in looking at this issue; else there is no incentive for US goverment to cut checks to Indian Goverment from a SS Fund that is already depleted and broke.

There is no freedom and especially education in India. in US even if you are a 60 year old you can join a university but in India things are different
What do you mean? My father was an engineer and he started his Bachelor of law at age 58 in 1996 in India, after retirement. regular college, which only 10% pass out off.
Again never compare Canada with India, India is Unique and I am not putting my Motherland on Trash, You are in a way doing that, by comparing it with Canada and USA.

Yes, I agree.. those roaches need to be crushed down with good governance..Unique Identification Authority of India (UIDAI (http://en.wikipedia.org/wiki/Unique_Identification_Authority_of_India)) project is the first step of that process to have transparency to credit system, risk assessment, tax accountability, govt spending, crime control and so many others.. ... I think it will be a reality in next few years. similar development perspective is up with china now..they increased domestic consumption rather focusing only on exports..

the best way to get more support is to be more inclusive .... what I mean is 1) either we have a parallel campaign for those who are on EAD's only 2) add EAD issue to this campaign too.

This year's peak home-buying season was lackluster, as buyers seeking to trade up to larger houses were absent, said the head of one of the country's largest real estate firms.
Jim Gillespie, president and chief executive of Coldwell Banker Real Estate, in an interview with Reuters, said sales were only modest during the spring, with demand overwhelmingly dominated by first-time home buyers and investors.

Move-up buyers are those seeking to trade in their current home for a larger one, and Gillespie said that group is important for sustaining a healthy real estate market.
Because of the sharp decline in housing prices and the collapse in consumer demand, homeowners are having difficulty selling their current homes to move up to pricier properties.
"They are key to a U.S. housing market recovery," he said. Gillespie said some of this lack of demand could be alleviated through more incentives. He recently met with U.S.
Congressional leaders to discuss housing, and said he supports a bill currently in the Senate calling for a $15,000 tax credit for all buyers of primary residences, with no income limit, for a period of 12 months.
The current $8,000 tax credit, first passed in February as part of a $787 billion fiscal stimulus plan, is limited to first-time home buyers and expires at the end of November. The proposed plan would expand eligibility to all home buyers and increase the credit to $15,000.
The U.S. housing market is in the midst of its worst downturn since the Great Depression. Home prices have been falling since peaking in the second quarter of 2006, and the Obama Administration has tried various measures to restore that market through tax benefits and temporary halts to foreclosures.
"Congress is focusing on the foreclosure problem, which is a good thing, but they need to focus more on the demand side," he said. Gillespie said market realities have come to bear as well.
"Many people got spoiled by mortgage rates at 5 percent and below," he said. "When the mortgage rate rose above 5 percent, it spooked many buyers who were already hesitant," he said.

Too many people converted to perm-EB2 when EB3 retrogression hit. Also, excess EB2 RoW are not flowing to EB2-India but to EB3 instead.

I agree 100% with the previous post person.
I myself am a PMP. It is very easy to do one, you need to have the right project mgmt experience (PMI may audit it) and you need to prepare for few months and you can clear it easily.
But the question is, more than the exam it is the practical experience, sometimes this job can be so frustrating and you feel like a sandwich being hit on both sides.
If you already have a PM experience and you dont have the certification, definetly go for it, it is worth the spending.
Again remember it expires in 3 yrs , you got to keep renewing your PDUs to stay current... its not like MCSD or MCAD which is for life long...

Same situation here too. My husband came to this country in 1999. Filed for greencard in 2004. Labor was sent to philly BEC and it got cleared in September 2007 so we too missed the window too. Not sure what to do

The cardinal rule of working with untrustworthy employers is that you need to use ONLY YOUR OWN LAWYER.
The lawyer must be having you as client and also must not have your employer as his client for other cases matters. ONLY then, the lawyer will be working in YOUR interest and not in your employer's interest.
I think people browsing this site by this time, must have learned one thing and I sure have said that a million times.
IF YOU CANNOT TRUST YOUR EMPLOYER 100% THEN YOU NEED TO SHELL SOME $$$ AND HIRE YOUR OWN LAWYER FOR ALL LEGAL MATTERS AND ALL PAPERWORK, FILING, PETITIONING ETC. EVEN H1 RENEWALS.
At the end of the day, between your first day in United States and the day you get your GC, it will cost you nearly 10,000 to have your own lawyer and never use the company-provided free lawyer.
Having your own lawyer means:
1. You pay him, you employ him, he is accountable to you, not your employer.
2. He/she works in your interest, not the employer's interest.
3. If your employer is not co-operating, you will know right away.
4. Your employer would have to come clean and truthful about his intentions of not filing 485. When you have company's lawyer, then the company's lawyer is not going to listen to you. WHY? Because you are not the one paying him. Your employer is.
5. Full transparency and visibility, whenever anything is filed, receipt is issued, RFE comes, reply to RFE goes, etc. With employer's lawyer, you have 0 visibility and you will land in situations mentioned above.

The reason they tend to have free lawyers for you is so that they can have total control over your immigration case. Its "Free" for you, but not really. I hate to say it but this is starting to sound very much like an Alcoholics anonymous support group session. LOL.
Let me jump right in!
Get a grip guys. Life is not so bad. What you guys are worrying about is relatively trivial. The odds are heavily stacked in your favor for you to get the green card eventually, most likely within 2 yrs. I can't fathom another 2 plus years with no legislative relief. In the mean time as long as you stick to AC21 rules, you should have the courage to move jobs. Heck, with EAD, you could even move into something part time and try it out before finally deciding to commit etc. My point is you have tremendous flexibility, enjoy that.
In the small chance things do not work out, then you have presumably had an opportunity to save enough to purchase a decent home in India(or wherever your home country may be), a car and your line of work(I'm referring to the predominantly IT folks here) is in such international demand that you will be able to earn a livable wage anywhere, including India.
And here is the real shocker to many of you. There are millions of Americans(probably well over half) who will trade their position in life with you in a heart beat given the privilege, family and social support system, education, world view and demand you are in. Sometimes it is hard to see how blessed you actually are in this world. That is why I have taken a very grim view of people who have compared their issue to slavery etc. That only speaks to their unawareness of that practice.
Now I know none of this is going to get you your green card tomorrow and improve your mistreatment in this needlessly ridiculous and tortuous green card journey. However I am hoping it atleast gives you some perspective.

I suspect that the sponsors of this bill aren't aware that some children who entered legally also need a break.
It may be worth writing to Dick Durbin and some of the co-sponsors asking for favorable treatment for children who are here legally. Write a letter and send it via Fedex/Priority Mail as this is being considered next week.

they have delayed processing time so more people will file for premium processing and they earn more money. H1b quota is not filling up and all of a sudden processing time went from 2 to 6-7 months in 1 month. Because so many people ( h1 - h4 ) might be travelling in dec - jan season. Come back in feb - march and processing time will be again 2 months.
