happy to see so many folks can finally apply for I-485 and many stuck in retro can finally get GC.
my PD is nov 2005 so I guess we will be waiting to apply for I-485 for a while (perhaps, 3-4yrs)

You will have to file an amended petition to be in compliance.
The PW could be different and you can check that on the OES website at flcdatacenter.com
Hope this helps.

When I went on a vacation to India, I had a valid H1B visa stamp that was valid for 30 more days. I also had an approved petition for extension.
I could have gone for stamping, but I chose not to and when I came back I showed them my H1B visa which was valid for 10 more days and also my extension petition. I was sent to Secondary Inspection (you can also be sent here in case you have an AP, nothing to be worried about SI, it very common nowadays). In that, a senior IO looked at both and then stamped my I-94 till the end of the extension petition (Oct 2010).
Though your situation is slightly different - you dont have a valid H1B stamp when you go to India, you can go to consulate and get it stamped with current H1B petition and while coming back you need to show the IO at counter both the VISA and the extension. Better yet, as some-one suggested, present both petitions to embassy in India and see how they handle it.
Have a safe trip..

Hi,
Generally FOIA does't give approval notice. But other stuff you recieved should be enough. What date did you use for port of entry, your first one or the latest one?

This is a personal Message from me TO the IV Core and its founder.People can keep it alive by thanking the core.
I Thank the Core and Aman for their dedication, support, campaigns and whatever they have done to bring about the latest development and a big big releif to everyone in the Legal community.
While all other web sites and forums were just picking things from IV , IV was leading in updating and keeping the members informed about each and every development.I am sure they had been primarily instrumental in getting this done. The issue has and their effort has not only given this releif but have brought the burning issue to the limelight and in the eyes of lawmakers and the Govt, which will now lead to a larger and sustainable solution to the IV community.
I once again THANK each of the IV Core members and other members for really making the IV a force to reckon with...
THANKS AND REGARDS

Before you request for your passport and withdraw your H1-B, make sure your AP documents were approved before you left India.
I have heard from several sources that your AP should be approved before you leave the country. If the approval date is a few days before you left U.S, it can be assumed that you physically recieved it before leaving.
You may want to check with an attorney to confirm this situation. In these forum, you will get personal experiences, but it may never be the exact situaton as yours.

It takes 15 minutes at Boston ASC and you are expected to arrive 5 minutes before appointment just so that you can fill up a form. And you can take any copy so long as it has your name , Case # and A# on it. Its a simple process - no sweat!!!

Seriously???
Ok, let us assume I am a manner less fellow. I am still far better than you who is feeeling resentment against someone because of that person's advantages.
You are the first one who quickly posted saying 'Not Good'. Any one in the world will say, you were abusive to the OP. Practice Nirvana, it will be good for you.
Gcmuddu , u r still eb3 coz u r so abusive,
u must have abused to the lawyer also
so she let you rot as eb3
I hope all eb3 gets the card but you get to
go back to the culture you belong, coz u certainly
don't fit in USA
Do yourself a favor , learn manners, card
will not teach you that.
Btw how does ur family tolerates you?
Or are a big hypocrite to tell ur son/ daughter(if any)
to be polite and here in public forum u bad mouth
wish your mom should have taught you more
I feel sad when you say "kutte"
noone should loose their loved ones soon,
else they try to find them in public forums,
good luck

I had this discussion with my lawyer. This lawywer has been touch with USCIS very closely and understand the process and how the system works (to the best possible for an outsider) and here is what has to say about LUD.
************************
Most I-485 will be adjudicated without any LUD at all. This is an because even today it is the physical file that is being delivered to an IO. IO will not touch the system if there had been no issue or no infomation to update.
If one is getting LUDs on any application, it most likely implies that some information is being updated. LUD most likely are for some reasons.
The process of adjudicating a 485 is multi step with many department involved. When the file reaches an IO for the decision , it is expected to be complete in every respect. If IO has any follow up question or any comments, she would then enter in the system that we se as LUD.
Thus, LUD in most cases ( and not all), if at all, is a potential indication of further delay..
I am not aware of any concrete reason for LUD on an approved I-140. My discussion with USCIS indicate that it may be due to updating of company specific information and not necessary related to individual case. Internally the the system recognize each company by a specific number.
Regarding your question LUD on AP, it should be unrelated to 485 as it is handled by a different department and lower level officials.

Guys, Sorry for my ignorance but
I was checking vfs-usa.co.in website and in "Immigrant Visas for East & West " section, its written
An immigrant visa allows the person receiving it to live and work indefinitely in the United States. Immigrant visas are issued based on approved I-129F, I-130, I-140, I-360, or I-600 petitions that establish a family- or employment-based relationship between the petitioner and the beneficiary.
I have my I140 approved through a american company and my h1b is getting expired in june 09.
According to above wordings, I can get a visa to live and work indefinitely, based on my approved I140. I have never heard about it.
Might be some one can explain what is exactly means.
Thanks in advance!!!!

Having an approved I-140 does not mean you can 'indefinetely' work and live here automatically.
It is ONE of the steps to clear on the road to legal immigration.
Please consult your lawyer and he should direct you as to what to do next.......

Hey man, there are like 2 other threads on this, but I'm glad that you brought it up, because this subject seems to have fallen by the wayside. I think that we should take this initiative by Senator Specter into consideration as part of our September 13 rally efforts, thoughts?

I have approved i-140 and I have applied for 3 year extension for my H1-B (I am currently in the sixth year of H1-b). If I switch employers, would I get 3 years on my new H1-B or time left in the sixth year? I am willing to restart the green card process due to stalled immigration reform bill.
