I have just called USCIS and spoke to very good and friendly lady IO. She has told me that in case if our applications is rejected for any reason due to lack of intial evidence,less amount of check or any other reason they will send a notice for re-submittal of application.

I can give you my example. 10 years in the US and got greened yesterday. Background -
B. Tech. from IIT - 1999. Always believed in hard work and dedication.
2000/2001 - Came to the US
2003 - Filed labor - RIR - EB3
2004 - job loss
2004 - Joined so called fortune 500 company with 15000 + employees and presence in 50 countries. They promised but never filed GC.
2005 - Filed Canada PR.
2005 - Quit and joined Desi company. Started GC process on day-1.
2005- Filed under Perm EB-3 (lawyer screwed). Got approved in 3 months.
2006 - Filed I-140 got approved in 3 weeks.
2007 - July Fiasco and filed I-485. Got AP, EAD. Wife started to work.
2008 - EB-3 sucked so talked to employer to file in EB-2. Desi company did not care as long as I paid for it.
2009 - Filed labor, got approved in 6 months.
2009 - Filed EB2 I-140 and requested to re-capture the PD of first labor.
2009 - I-140 approved, same day saw an LUD on pending I-485. Also, approved I-140 came with A# and EB-3 labor PD.
2009 - Bought a home.
2010 - July, dates became current.
Opened SR, got a response that my case is still in EB3. NSC sucks.
Asked lawyer to send letter to USCIS. He did, nothing happened.
Contacted senator and they opened up a congressional request with USCIS.
Within 2 days, USCIS issued RFE about incomplete medical. It was total BS.
Contacted doctor and got chest X-Ray and replied RFE.
Took several Inforpass appointments.
EAD expired, did everything but could not get renewed on time.
Did not tell anything to HR about expired EAD, both kept mum and kept working.
Had fights at DMV to get DL extended.
Aug-17th, GC got approved.
Is this all worth it? I do not know. Only reason I joined desi company with 2 employees is that desi company was ready to file GC on day-1. I have seen so called Fortune-xx companies. They lied to me.
Overall - I am a happy person. Would continue with Desi employer for some more time.
Now that we have GC, I would like to -
1. Spend more time with family and not worry about LIN-XXXX numbers.
2. Think about doing MBA.
3. Move to a warmer place like CA.
Good Luck. I would suggest - Talk to your employer and explain your situation. You have nothing to lose.

USCIS has long been plagued by an application backlog, slow processing by poorly trained personnel and an inability to track applications for people. Gonzalez said the increase would pay for better facilities, more workers and more training so that applications can be processed faster and by a more courteous and professional staff. Customer Service creates a service request and send just standard off the shelf letter saying wait we are processing your case. The letters used to say 3 months but now sayd 6 months.
I think a lot of ppl in this forum are under the misunderstanding that once their date becomes current they will get Green Card soon. That is reaslly not true and once your date becomes current its just another battle all over again.
Some ides that I have heard work are
1) Calling congressman/senator and asking them to help your case.
2) Writing to Ombudsman.
Since no one in America does much of anything in December I am planning to start trying with congressmans office in mid Jan. I have to do something and try - I cant keep sitting hands folded. Or they will say quota is over before we know it - remember ROW is at 2005.

Thank you very much Dinesh for this. Currently my spouse's passport is stuck in the same place for god-only-knows-what reason. The embassy staff said they are auditing every 2nd-3rd application. We have the AP but we were thinking that if we withdraw the H1B application, the embassy people might stamp the passport saying "Application Received" which sometimes can be a euphemism for "Visa Denied". I once got such a stamp when visa was denied to me.
Since we would then always have to keep explaining at every stage why we have that stamp, that's why we are sticking on with H1B delay. We have been given the same time-frames as you were.
When you withdrew your passport to travel on AP, did they stamp your passport with any text? Also could you please tell us the procedure you followed to withdraw your passport and whether you could collect it in person? We have been asked to email the US Embassy for withdrawing from our H1B application.

I got my I-140 Approved in 2007 and I-485 applied in July Fiasco. working for same employer who filed labor in PERM. Recently got letter from DHS stating that I485 denied as it was filed when dates are not current.
In july 2007, USCISreleased memo stating that they will accept all applications till August 17' 2007. Mine was reached on Aug 14'2007 well before deadline. Got I485 reciept in october 2007.
There are 2 dates on receipt. 1. Received Date (Aug 14) 2. Receipt Date (Oct 12 ' 2007).
They sent Denial letter to Attorney on 01/19/2009 stating that I485 application was filed when dates are not current , they mentioned that on the day receipt date (oct 12' 07) dates are not current.
Took Infopass and went to filed office where I was told that if I this it is USCIS Service error, file MTR .
Filed MTR thru Attorney on Feb 5 09. Filing Fee is not enclosed as it is USCIS service error.
(This was done as officer at USCIS told that Fee need not be included as it is service error, attorney also agreed with this statement).
Till date I did not get any communcication from USCIS. 2 months have been passed.
Please advice me on this issue

USCIS mailroom has certain protocols and thats why even our AC21 documentation does not reach file.
Files are distributed to different officers and they work on the files.
Without a receipt number you cannot track your MTR.
Talk to a very good Attorney on further course of action.
I filed MTR - my 485 was denied because the officer ignored the AC21 job change. When I called customer service and explained - I was transferred to a VO and when I explained it, she requested me to file an appeal so that I don't have to pay instead f MTR.
When I talked to Attorney - she said "Don't do that - when your MTR gets receipted, you can track it but cannot track an appeal"
Remember MTR = if USCIS makes a mistake - MTR costs $$
Appeal = if you want AAO to consider various factors on a correctly interpreted denial and appeal to see if you can convince.

We should stop following bulletins and focus more on lobbying.

I agree with Communique some parts.
I had been lived in Toronto for last 4 years.
Frankly speaking, Toronto is a very good city. I feel it probably can match up with Chicago, or 50% of NYC.
Multi-culture is even more obvious than in NYC.
But keep in mind that there are less high buildings than some super citys like NYC.
When talking about job opportunity, it is better to compare city with city, not country with country because actually once you settled down in one place, you probably can not go hunting jobs in another side of country.
So, the job opportunity # in GTA (Great Toronto Area) is about 75% of Chicago or 1/3 of NYC.
Many people told stories about immigrants can not find job in Canada. That is not true. The truth is that most of immigrants go from USA get job within half year even in 2001. I admit that some immigrants go direct from their homeland do have hard time to get job in Canada because of lacking English communication ability and North America work experience. For people who have been worked in USA for some time, finding a job in Canada is almost guaranteed.
The thing I don't like in Canada is that the workload is light and business is quite slow. So many lazy colleagues and from time to time union threaten to strike (for raise salary). Lots of our taxes are wasted for this huge government's unnecessary spending.
As of discrimination, I don't think there is too much. I feel there is some, but not very obvious. Part of the reason I think is because lots of immigrants actually live better than average traditional Canadian. It is true that many local teenth only finish high school and enjoy work as labor. You could say that is jealous.

I think calling your university presidents and asking them to show their support for these bills would also be a very good idea.
This bill will encourage pursuit of higher education in US by foreign students in a significant way.
I think this is a good idea. All US graduates should Email or fax there University Presidents. As we know congress does listen to the education industry. All IV members graduated from US universities should contact there respective university presidents.

Note that the TSC processing date for EB I-485 moved back to April from May 24, 2007. So the flood of applicants from June are certainly not "within normal processing times" even if they fell out of the BECs and have an early PD, and have a namecheck pending >180 days.
I agree that sucks. They should be processing based on PD and not RD. But when and if this >180 days policy for namecheck gets streamlined, and with PERM implemented, processing will be more FIFO than ever, even though IOs work on their own whims and timelines. I doubt visagate filers will see FIFO, but future filers will.
