Thanks for the input. Do you have any publications or IRS findings that you could direct me to that could be used to substantiate the argument that the benefit is non- taxable? I have not been able to find anything that says that the green card is non-taxable.

Hi,
My 9th year H1 expires this month and I am planning to use EAD to continue in my job (not extending my H1B). Can you please tell:
1) What do I need to do to with respect to Employer and USCIS to move to EAD status from H1B?
let your HR know you are switching and they will have you fill in a new form for their files
2) I read in some forum posts: there is a new law OR amendment - people working on EAD with adjustment of status will be deported.. we need to continue maintaining H1B status..is it legitimate?

3) My current Advance Parole is valid till Oct'09. As I move to EAD, is AP renewal required for any other reason other than travel purpose?
EAD and AP are 2 separate things and neither affect each other. They are both based on a pending 485 application and that's about all that is common with those 2 filings.

I moved to a new company and yet to receive my I-797 approved from INS. My old company visa is valid till May 2010. If they have not revoked it can i still travel out of country and come back?

I have a permanent employment offer from the employer where I am contracting, right now for the same job. Following are the questions I have:
1. Can I change my employer?
2. Can I retain my Priority date?
3. If the new employer files for transfer of H1, what does it mean to my extension beyond 7th year?
Please help.

I think they carry only their own documents + hdfc receipt etc stuff in original.
All other documents (that are not issued to them) are a copy e.g. your I797 notice, copy of your passport, visa etc.
Your Birth certificate is one such document hence copy should be fine. And also your passport also has a name of each parent.

Our (Me / Spouse / Kid) I-485 is pending approval and our priority date is May 2007 EB2 India. I am planning to send my spouse and Kid to India for kid education. I do not want to cancel their I-485. They may stay in India till I get my GC :=) ( I dont know when)..
Initially I thought of bringing them to US every year to renew the AP. But It is expensive for me and I am thinking it is not a wise idea.
I am thinking of applying the Consular processing only to Spouse and Kid in India. They are dependants to me. I am the primary applicant. Is it possible/allowed to apply consular processing only for dependants and keep the Primary applicant in AOS

I think this is due to bi-specilization program USCIS started lately. H1's are processed at CSC & VSC just like I-140's processed at TSC & NSC.
So your application would have gone to VSC when they share the applications for processing, though you belong to CSC.
I believe my resoning is correct!
