You said she got a H4 stamp when she first came to the US based on your H1B. That could not be true. She must had a I-797 approval notice of her H4.
You need all her I-797s of H4. Check the starting and ending times on them. Their should be no gap between. Any gap, if during which she was in the US, means illegal stay. But, if she had left the US after the gap and returned legally, the gap wouldn't be treated as illegal stay when you file 485. The evidence you need to prove this the her I-94s. All the VISA she'll ever has are the ones in her passport.

The question is when.
Before or after the fall elections.
The current thinking is somehting will pass in the senate. Most likely with some sort of temporary worker status for the illegals.
If it offers a path to citizenship for the illegals then it will die in congress, if not then it stands a chance in conference.
If there is deadlock then this issue will be pushed to until after the elections.
That's my take on things.
Did you guys see Sen Frist on CNN wolf Blitzer show? Likewise that was the view of Sen Grassley.
Sad for us we are stuck in this politics.

Every attorney handles a case in different way. But sure your Bank statement reflecting a direct deposit will be a substitute for your paystub.

Hi,
I am (L1 B) in US since April 2008 with my wife (L2). Our I-94 and VISA expired on Oct 08. Before expiration my company applied for the extension of L1 (I-129). The status changed to "Request for RFE" on Feb 09. Got the RFE with 11 questions yesterday. The questions asked were more about my specialty, my company and the clients contract, other fellow aliens from my company working for the client's status and profiles. So now not sure what my company will do with the RFE.
My questions are -
1. If my company withdraws the L1 Extension petition, then how many more days I will be able to stay in US legally.
2. My wife is currently 22+ weeks pregnant, will US Govt consider anything for her medical situation?
3. Whats the possibility that VSC will accept the extension if we send the answers to the RFE?
4. If the petition is denied, then how many more days I will be able to stay legally?
I would appreciate if anybody can answer my questions.

What kind of issues with the case would prompt an RFE for the 485 before the 140 is processed? Is this for a second set of fingerprints or could this be something more serious? I got married recently. Both my husband and I have similar priority dates as labour was filed separately for each of us by our respective companies. Is there any downside to adding each other to our applications and dual filing for greencard?

Recently I got my I-20 and Now I will have to get F1 visa in order to register for classes. I don't have enough time to get my status changed from USA.Please can somebody tell me what will be the procedure of getting visa from Mexico or Canada? And how long this procedure takes ?

By courtesy copy do you mean the original I-797C?
I am also in the same situation. I didn't get the copy and lawyer got copy today only. Appt date is this Sat.
Lawyer has emailed me the scanned copy. Can I take this copy for FP ?
