However, the offer letter has a clause that is a bit strange and raised some doubts in my mind. Experienced people please comment and let me know if it has a risky hidden meaning. Please note I am not going to take any trainings and would start to work immediately with one of their clients. The clause goes like this.

If your h1 expires Feb 12 2010, i.e. you still have 2 more years.
Assuming: 140 approved and 485 filed.
Now if you use ac21 with h1, you would only get 2 yrs of extension and there after only 1 yr. (attorney said, if you have 140 approved you get 3 yrs extenion. but once you file your 485, you get the remaining time of 6 yrs or if you are in your 6th year, then you get 1 yrs extension).
Hope this answers most of the quesitons.

I have one question on this for some reason if EB-2 Perm is not approved then can we still reatain the EB-3 priority date?? and the EB-3 status.??? I have a masters and 5 years of experience and same situation almost like yours.

If someoe is on H1B then he converted to H4. Then He converted to H1B.

I was denied life insurance by Erie based on my non-immigrant status. However, my employer found an alternative insurance company that did not mind my non-immigrant status - but of course charged a premium for the "added risk accrued by foreign citizenship and increased possibility of travel abroad". Its of course a different story that I CANNOT travel abroad frequently precisely for the same reason - the increased risk of DHS denying entry due to foreign citizenship.
I got a quote and passed the physicals, and only two months later was told the underwriter doubled the premium because I did not have green card.
For mortgage, you have to shop around to find one that does not mind your non-immigrant status. I was able to get preapproved for a first time buyer loan with low rate. But I did not purchase the house. So I will not know if they would jack my rate up at closing because of my status as the insurance company did.

In a matter of minutes my indicator has gone to 3 reds. Am I missing something... ?!!!
Dont worry too much about the reds. Even I used to have a couple of greens.
But when I saw many people complaining about why IV is not pursuing piecemeal,
I explained them about the Hispanic caucus and CIR.....I started getting reds
because of that.
People often give red even for rational and logical postings here if the information is uncomfortable.

All he is going to give is 2K more than normal lawyer fee, which is just a 1 dollar per year for an hourly employee. I would advice him to happily take this offer and file without any complication with employer.
Note desi employer (consulting company) are doing us favor by applying GC, other wise where the heck they have a permanent job.
Take it easy now and ACt after 6 months of filling 485.
Also these days lawyers have to do Overtime to prepare documents for sudden surge of new filers.
Ask your law firm why they are charging you so much. Below are the rates charged by my lawyer and should not be too different from what most of the others charge. If the lawyer doesn't answer, then show these numbers to your employer and lodge a strong protest with them.
Adjustment of Status
Principal applicant $1,000
Dependent applicant $500
Work Authorization Cards (each) $200
Advance Parole Travel Documents(each)$200

well this is your time. with eb3 row 2009, you probably are in wait for at least 5 years. Anyway the point is, no country would be stupid enough to stop great talent from coming through to satisfy it's diversity policy. When you are talking about 0.14 million immigrants for a nation of 300 million, that's less than 0.05%. So please take your diversity argument with you and don't let the door hit you on your way out. For this miniscule percentage, the US will lose out on thousands of the best Indian and Chinese engineering/science talent. US's loss, India/China's gain. If this is not an example of an extremely stupid strategic policy then I'm not sure what is.

My infopass appointment was this afternoon. NC cleared. All the IO said was I should wait as there were many applications filed on 7/2/2007.
I mentioned once that 2006 cases are getting approved and with my PD being in 2004 when should I expect to get my 485 approved. All I heard back was WAIT :mad:.
Not sure how long though. Been seven years since I filed, first in 2001 and then again in 2004. Looks like a never ending wait.

Such increased demand could have dramatic impact on the cut-off dates. Readers will be provided as much advance notice as possible should this occur.

I read somewhere that doctors abroad who do the tests for consular processing cannot be used for AOS medicals.
u'll get RFE only if theres is a mistake in medicals, if there is NO medicals in the 485 packet, i think ur appln will be outright sent back.
whats ur PD, if its in the range of 2000 u still have hope that in next few months ur date becoems eligible for AOS.
ive heard that there are some doctors out there (of questionable integrity) who accept cash and give out medical reports. even tho this is a backdoor approach, u can make a few calls and give it a try. to make ur case more genuine, try to get a list of all attributes recorded in the blood and skin test, and get those done promptly done in india. atleast let the doctor copy over ur wifes actual stats rather than inventing it. If ur case is genuine, may be someone will be merciful to help u out of ur predicament.
Preponing visa interview without very valid reason cud be harmful. u never know, if they catch ur wife telling a lie then ull be walking on thin ice.

No surprises for me at least. There will be only 816 new EB3 visas available for any country in October. This will move the dates at the most by a month or two and this will continue for ever until a new legislation is passed, that is why DC rally is all the more important and everyone should focus on that to bring in a change.
For folks wondering how I came to the 816 visa number
Total GC available = 140000
7% country limit = 9800
split for EB3 = 3266
spread for each qtr = 816
Good Luck to all and don't have high expectations because you will be disappointed when the bulletin comes out.
and 816 are not primary applicants.... there are spouse and kid(s)...
