That exactly my point too. Any unique protest idea should be shared among us and saved for future use.
I agree that protest idea should not be misused. They have listened to us once now they will say "what else they want". Though there are more long terms issues but i guess protest ideas can be saved for later on or wait for the momentum to buildup itself.

my lawyer missed the 2nd july deadline even when he had all the papers. Now i am asking him to meet 30th july deadline he is not responding . what are the papers needed to file I485. Can I file it without lawyers help? He does have my immunization papers

It might have been okay if you had tried to transfer from H1 to H4 after a few months of being on the bench; but 3 years out of status lol.
Talk to an attorney, file a DOL complaint against your employer; but if it comes out that you were out of status for 3 years, I think your chances are pretty bleak.

I need help on my 140 filings. My situation is:
02/2004, applied EB3 LC, pending until 02/2007
10/2005, applied PERM EB2, LC & 140 approved, but unable to file 485 due to retrogession
in 02/2007, my EB3 was certified. I asked attorney to file EB3 140 to capture this earlier PD to my EB2 case.
But the attorney hired by my company refused to file another EB3 140. His reason is: it may be questioned by USCIS to file a EB3 140 after EB2 140 is approved -- my job position is downgraded. And back and forth I will still use EB2 to apply 485, then it may bring the company to a potential fraud issue, blah, blah...
I know that the company is reluctant to let me get gc quickly, so the attorney found this excuse. I did not find strong proof to refute this excuse.
Is there any legal proof (like USCIS memo, AILA Liasion meeting minute, etc) to refute this excuse and convince the employer to go ahead to file 140 for me?

Even I got Duplicate I485, I765, I131 receipts. All the receipts has same A#. One set of I765 & I131 approved. For the second set , they send REF about Photos as I have not submitted any supporting documents ( Photos, I94 etc) for second set. I have submitted second set as follow up since I didnt get recepts for the first set within 5 months.
Now I want to withdraw duplicate I485 another set. What happen to your I485 withdraw. Any problems ?
Please advise ...

I am sorry to hear you are still wading through the labor cert stuff. Mike Delph has little or no knowledge of how the immigration system works. My family and I found this out over six years ago when he worked for Dan Burton.

Any thoughts why EB2 India hasn't gone beyond Apr 04 for over a year.
Is this because of EB3 to EB2 conversions? If so then the likelihood of EB2 - I dates moving a lot in Oct bulletin are low.
Are there any 'guesstimates' out there for the number of EB3 to EB2 conversions?

My son is in custody and I am bonding him out this week;
ICE charged him deportable as a Aggrevated Felon becuase ;
He had a PETTY LARCENY in 2009 (misdemeanor) - orginal sentance to 60 days weekend intermittent jail and 3 years probation;
He violated probation and was given a year of weekends by the judge;
Now ICE are charging him as a AF saying he is deportable because his record shows 365 sentance for the petty larceny!!!
I an others disagree and that 'a year of weekends' is NOT a sentance of a year or a suspended year;
Any case files or history anyone - your answers are welcomed!

Hello friends;
Need some information on studies while on EAD. I am a EB3 (Aug 2004) and so my daughter too. She is in final year of her graduation and applying for Med schools after a competitive score in MCATs. Got a rejection from Arkansas college as she is not a GC holder yet. So I was wondering if anyone studying medicine on EAD?
Most of the colleges wont say about eligibility while applying and the application does not have a immigration category for AOS, it has Dependent, F1, GC and others. We had to go with Others option, ofcourse specified about AOS in rermarks.

I just thought of sharing this update on my case for the benefit all those whose apps were received by J Barrett at NSC.
My checks got cashed last night. The details are below:
Received by J Barrett at 10:25 AM at NSC
Case was transferred to CSC and back of our checks show receipt #s as WACXXX
I had an LUD on my approved I-140 on 7/28/07
My I-140 was approved from TSC in May 2006
My PD is Jan 2006; EB2-India
