Hi All,
I am currently working for a University in cap-exempt H1B (company A). I got a job offer from a cap-subjected company (company B). I am aware that the H1B which i have is non-transferable and i have to apply for new H1B petition to work for company.
Since the cap numbers are still available, applying for new petition is not a problem. I was in an idea of asking my new employer (company B) to apply for new H1B petition (premium processing) while working with Company A but i came to know the following from USCIS official document that i have to stop working for the current employer before submitting the company B H1B petition. I thought I can work for the cap-exempt company A until the company B H1B is approved. Have anyone experienced it? if so when should i stop working for my current cap-exempt employer?...can i work till the LCA is approved..?
Below is the paragraph from USCIS Memo
"If the H-1B alien beneficiary has not �ceased� to be employed in a cap-Exempt position, then he or she will not be counted towards the cap.
If the H-1B alien beneficiary has �ceased� to be employed in a cap-exempt position, then the alien will be subject to the H-1B numerical limitation, and the concurrent employment petition may not be approved unless a cap number is available to the alien beneficiary.

H4 people used to use TaxID instead of SSN in their tax returns (joint filing for ex.). What do they use when they get SSN after EAD ? Do they use SSN or just the Tax ID. Is there any requirement that they inform IRS that they got SSN and start using it instead ?

I'm from Bangladesh and EB3. As you know the I485 was current in July and i applied along with my EAD and AP. but this month in visa bulletin i found that the date went back to 2002.
My question is: are they going to consider my application current or i stuck in the backlog. my understanding is that the visa bulletin reflects the availibility to send the application....they received my application on July 2nd, 2007.

your application will be accepted and processed (since you applied when your date was current), but it cant be approved until you are current again. So you can keep getting/renewing EADs/APs, security and background checks will happen etc, but no final approval until EB3-ROW becomes current for your PD.

Regarding reentry, there should not be any problem for your Mom as the bills were addressed to you (so her name should not be on defaulter list).
There is insurance (Visitor Health Insurance, Pre-existing condition coverage, AIU (http://www..us) - which covers pre-existing conditions) and their rates are competitive. But I've never had to file a claim, so don't know if they would be different...

I recently updated my address thro AR 11 online and also submitted the SRC numbers for the 485 pending for myself and wife. I received a mail (post) stating that USCIS has received my change of address notification and they have udated the new address to my 485 application. I received two seperate letters for me and spouse. But there is no change online on LUD's to those case which are 11/4 when my fingerprinting status was updated. Does this mean USCIS has goofed the address change? I have safely filed the USCIS receipt's with me in case they create issue in future. :o

Here are things that you can do to protect your ID. My id was stolen about 7-8 years back and ever since I have been extremely careful
- Call all three agencies(Equifax, Transunion and Experion) and put a HOLD on all new accounts being opened in your name. Say your information was lost in mail and you think there is a possibility of ID theft. You can also put a freeze for your account, with the option to open based on calling your cell phone or home phone
- If you have Citibank Master Card, they offer ID protection program for 1 agency for $6.95 per month...there are other Credit card and banks that offer for $12/month for all three agencies. In my opinion 1 agency update is good enough
-Call the police and register a case, as soon as you find somebody has stolen your id
- have alerts in your bank account to show deduction or auto withdrawals of more than $500
- Shred all personal and financial documents that state SSN, DOB, and any other personal details
- Beware of a Id security protection agency scams from companies that show SSN can never be stolen. The CEO who adverstised that this is my SSN and you cannot steal it...his own id was stolen later
- get rid of all cards that you do not use. if there were credit card details in the package, call credit card company and ask them to re-issue new cards with new numbers

I need your opinion. I came to USA in May 2005 and my H1-B is going to expire in Feb 2008, as per I-94 card as well as stamping of the H1-B visa. Thanks to USCIS ;) for opening the gates in July 2007, I had applied for I-140, I-485, I-131 & I-765, based on my approved EB-3 labor with PD 02/2007. While my I-140 and I-485 are pending, my EAD & AP were approved and received by me. My existing H1-B is expiring in Feb 2008 and my employer company has not taken any steps to renew. The Legal Assistant replied me cooly that why I cannot use EAD. I had been taken aback by her answer.
I have planned to talk to the top management of the company, but before talking to them I want to take all your opinion. Is it adviseable to use EAD in my situation? I have 3-yrs degree qualification and have been anxiously waiting for clearance of I-140.
I look forward for your advice,

So I have to join the new employer only after the new I-140 is approved right..my current I-140 is already approved..
You can move to a new employer and start EB-2 (PERM based LC, I-140 etc.) with them. You can still retain the old PD because your I-140 has been approved.

08/04 LUD on your I485 should be for approval. What does the message read? I had received RFE. They received the response for RFE on 08-01 for which there was LUD on 08-01. There was another LUD on 08-03. another one on 08-04. The status reads: "On August 1, 2008, we received your response to our request for evidence. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use our processing dates to estimate when this case will be done. Your current employer experience has to be prior to your labor filing date (PD). You can not use the experience you got after the filing date.
