    I did not send G-28 even though I have an attorney. I think that part is only if you want them to respond to your attorney rather than yourself.

    13 - I chose (b) and (c) since I had done both of those things. You should choose accordingly.

    14 - I left this one blank because I did not want to involve the attorney

    15 and 16 - Just write your name and sign. Make all family members do this to avoid separate forms for each

    17 - Leave this one blank once again because it is only if you want them to respond to your attorney.

    What is the root cause for namecheck issues ? the Ombudsmans report mentions
    a) the value/benefit of the name check process is undecided.
    b) lack of resources and funding to process all the name checks.
    (premium processing will provide those funds)

    immigration relief like recapture, more visas etc require congressional approval and i dont think we will see any till mid 2009 after the election is settled.

    Like 140 premium that program will be first suspended and then dumped eventually because there are resource and Process problems internally.

    Unless you fix root causes - these Premium things ain't going to work.

    This week, scores of highly-skilled professionals across various ethnicities and nationalities are sending flowers to the US Citizenship and Immigration Service in a symbolic act of "Gandhiism" or Gandhigiri, to demonstrate their displeasure and to request honoring of their Green Card applications filed in July.

    In response to this event, Academy Award Nominee Vidhu Vinod Chopra, who produced the run-away successes "Munna Bhai MBBS", and "Lage Raho Munna Bhai" stated, "Mahatma Gandhi has influenced several personalities, including American Civil Rights Leader Martin Luther King, Jr. These young, law-abiding professionals have set out to strive for reform the right way- the Gandhigiri way."

    The theme of �Lage Raho Munna Bhai� centers on the usage of non-violent principles to win over difficult and non-co-operating entities. In the movies, character Munna Bhai wins over the tough Dr. Asthana by means of chain deliveries of flower bouquets. The sequel has revived Gandhian principles and popularized the concept of Gandhigiri- literally meaning a symbolic act of peaceful protest across South Asia and the UK.

    Rajkumar Hirani, who has directed the Munna Bhai series, had this to say - "When you feel you have been wronged, you feel angry. The best way to overcome what you think is unjust, is to protest peacefully. Be nice to your opponent and let him see your point of view.     �Expectations ran high among applicants. Highly-skilled professionals and US employers have incurred financial expenses averaging USD 3,000 or more, per family in just filing and preparation fees, not including the rush to get medical examinations completed on time, or the resulting hurry to get supporting documentation from home countries. Several applicants have had to call off vacations or business trips to be in the US to file �adjustment of status� applications as part of the final stage of the Green Card process. Some applicants or their representatives even traveled personally to Immigration Service Centers to be the first ones to submit. Not to mention the downtime that has resulted in lost productivity to several US businesses", says Aman Kapoor, of Immigration Voice. Aged parents and families in home countries were inconvenienced to source supporting documentation such as birth and baptismal certificates, all resulting in naught.

    Although the ability to file for �adjustment of status� during July would not have granted the coveted Green Card, this move alone would have provided several interim benefits to qualifying applicants while waiting for their Green Cards- benefits such as the right to travel and right to work. Several applicants� spouses are highly-skilled and have been eroding their skills over the years in anticipation of a Green Card because they cannot otherwise work on dependent visas.

    Also, several applicants have been subject to career stagnation over the years and this move would have provided flexibility to switch employers after 180 days of filing. Employers would have benefited from paperwork reduction as well as additional legal fees required to frequently temporary visas.

    Says Kapoor, "Disconcert among highly-skilled professionals grew exponentially in the last few days. Several members, out of their own initiative decided to organize a peaceful protest in the Gandhigiri style to display their resentment.�

    Dr. Emilio Gonzales, USCIS Director, announced in a press release Monday that the agency would arrange for the flowers to be sent to recuperating service personnel. In the movie, Dr. Asthana finally relents to Munna Bhai's chain flower campaign. Although, this symbolic gesture has by highly-skilled professionals has evinced a reaction from movie moguls, it is hoped that the incident will prompt real meaningful reform in the US immigration system in the days to come.

    Dude, then why are we blaming people like punjabi.........it is not his fault that the supply was abundant and demand receded..........I would still blame the banking system for the housing failure.......they landed out money which they knew would stop coming back at one point in time........and again, it's not that he cannot afford his monthly payments...........he just cannot sell his asset - to me that is a problem on the part of the lender and not the borrower. No wonder banks are re-adjusting the home loan amounts (to a much lower value than originally specified in the agreement) for people who cannot pay the normal mortgage (due to whatever reasons). Go and teach the same lesson to these greedy banks and lending institutions.

    Again, I am not saying that foreclsosing (escapism) is a good route to take, as there are other ways to keep the paying the mortgage without hurting your mobility but at the same time it is not prudent to blame it entirely on the borrower - lending institutions are responsible for major part of this mess.



    gO learn the concept of supply and demand before asking a question as to why banks are lowering their appraisals!

    If you are offended, I don't give a DAMN!! I know about India very well and has been to India many a times. I know very well about the indian corruption which has no comparison with any country in the developed world. All you have to look at is the suveys from various NGOs that track corruptiy on at various countries in the world and you can see where India ranks relative to US or UK

    1. We all agree there are loopholes in each and every system. Are you trying to fill 1% by punishing 99% of the people. If you want to fix loopholes this is not the right place to be. Go to the court and fight with the adminstration. Why the hell you are wasting your time.
    2. Considering you are a anti-immigrant, and you want to fix the system. Are you targeting Employment based immigrants or family based immigrants. Employement based immigrants are just 17% of the total immigrants whereas family based immigrants are more than 50+ %. better target them. Don't waste your time since you won't get anything as everybody over here are working and US employers want them.
    3. If you are unemployed, please spend your time in findiing a job. The minimum salary in US is around 8 dollars a hour so you have wasted your entire day. close to 100 dollars. You have not earned a thing by writing your thoughts in this forum.
    4. Senator Grassley and Durbin are working on your side and they also like you don't want a google, yahoo, ebay and other firms to suceed iin US. Be prepare to immigrate to some other country in future.

    Another thought... they might have been confused with EAD through L1/B1 etc dependent and EAD through pending AOS. The first case is temporary and depends on the primary applicant status. See if thats their concern and clarify...

    It does not matter. EAD is unrestricted employment authorization and has no conditions attached due to basis it was issued. Of course, EAD can be revoked due to basis no longer available (such as expiration of L2 Status), but person can work as long as EAD is valid.

    This is not true. Recently, me and one of my friend got Home Loan for a good interest rate. It all depend on your credit score and credit history and not PR. You need to provide your papers properly. If you say some statement like this, please provide evidence.

    Why is everybody so happy? He has just briefly and curtly informed in the message that flowers will be forwarded. They won't be sitting on my desk and embarrasing me. There is no acknowledgement of the issue or any empathy or compassion with the sufferers. Now even the press coverage will make USCIS director look good. I don't see what's the positive development here.

    They probably tried to pass the irritant to someone else. If USCIS continues receiving flowers, and therefore passing them on, one day even the soldiers will say "No thanks!". Then they will pass them on to someone else. But for how long?

    I think this campaign will NOT lose its effect-- as long as we are persistent. Ideally, we should continue sending flowers at least so long as it does not become a MUCH talked about issue in the print and radio and TV media. My humble opinion.

    I called up to find that my application is still not in the system. Surprisingly, the IO would not put the phone down and keeps on chatting to enlighten me. Seem to have lot of time on hand.

    1. My application is most likely transfered to texas since my I-140 was approved there
    2. FIFO is valid only if the application is not transfered. Once it is transfered, the receiving center will take the date 'they' received to put in queue for data entry. If your application took continental US tour, more delay.
    3. He is asnwering 5-6 calls every day from July 2 filers. There are several of them. So plenty of July 2 apps still waiting to be entered.
    4. The application is not rejected for sure, since even a rejection would be entered into the system.
    5. he cannot raise a service request without receipt number.

    I sent mail to USCIS withe fedex scanned signature, wrote to Senator. Its frustrating.
    The bottom line is there is no bottomline, except to wait.

    For me also similar reply...From an IO.

    I got one more email with the update (this is third email with the same staus "CPO"). This time I have SLUD on EAD and AP also. Here is the email...

    My wife received here Welcome letter but I did not get one yet. Here is my timeline...


    09/08/2010 - CPO emails for self and wife
    09/09/2010 - Got emails updating the status to Decision for self and wife
    09/10/2010 - Standard CPO email to self
    09/11/2010 - Wife got the welcome letter (I-797) by USPS
    09/15/2010 - CPO email to self with the new message (Document sent to address on file)

    Still waiting for cards in hand.

    I checked with USCIS by calling them and they still have no records for me in the system. They admitted that there are many who have not been entered and issued receipts even though the dates at NSC & TSC shows otherwise.
    Adviced to be patient and call back in October 1st week. According to them its still not long enough for them to launch an inquiry to find these July 2nd applications.
    My lawyer also says she can't do anything yet unless they say that they have filed everything they have received.
    Again what a mess ...waiting for reciepts takes so long wonder when they will finally process the GC.
    I know many 2nd July filers who have even received EADs.

    I hope our patience pays off and they rewsrd it with giving the GC straightaway;).....wishful thinking.....

    I'm coming up with a letter that will address some of our issues. It will have simple content, point-wise.
    It will have
    5 Year GC, 10 Year Citizenship.
    Recapture of lost visas,
    How we can improve housing/job mkt.

    I may do it by evening. Can some of us help me in gathering some email addresses for people to contact. I can gather some. For Zoe Lofgren, I am not able to go to her site to send her an email, as it asks for zip code. Which Zipcode works for her, anybody..

    Till then can you please do us all a favor by bumping up this thread, as you do, we can pick up more members..

    Dont wait for a fruit to fall in your mouth on that day.. more chances for you to get struck by lightening.. better move from under the tree faster and buy a house..

    First: They will ignore you (that's what preciously happened for so many years, no ear eager to listen about the problems of legal immigrants)
    Second: They will laugh at you (that's what is taking place. Instead of accepting the mistake and offering an apology, USCIS has only issued a statement about forwarding flowers to Army Medical Center)
    Third: They fight with you (I guess that's what they are gonna do in the court)
    Fouth: Finally you win.

    So stay tuned guys ...... victory is not far away!!


    BTW whether or (as someone said, more likely) not we are strictly following Gandhian principles, I am sure he would have been unhappy for people who opt for inaction as opposed to any peaceful means of protest.

    I never said raising this issue is illegal. BTW I was not replying to "l1fraud". My comment was directed at "dilipcr" who is of the opinion that Grassley's bill is good and IV core and the forum should support it so that he can have a secure job.

    BTW is l1fraud or others raising this issue out of love for law ? no way. That was my point.

    The L1 visas done by the outsourcing companies are the main reason for the employment problem. These companies like TCS, Wipro etc.. bring people in L1A, L1B blamket visas to do the common development/Business Analysis/Project Management job in the client site.

    There is no quota for L1 Visas. They can bring any # of people they want. Per law the L1A s should be of senior managerial position with at least 4 subordinates working under them in US and L1B should be of specific skill very important for the project and not available in US. But the most of the L1As from these companies are just programmers/BAsor small PMs. They are directly controlled by their client manager.

    The main intent of these our sourcing companies is to send the employees on L1 and the employees are constantly told to somehow transfer the project to offshore.

    The L1 frauds should defenitely be reported. I totally support this initiative to report the L1 frauds committed by these outrsourcing companies.
