what are your plans for I-485 filing? are you going to interfile your existing EB3 485 application with EB2 I140 or file a new 485 application for EB2? what is your lawyer recommending?
Our lawyer requested as a interfile while filing the new I-140. EB2 dates were current at the time of filing I-140 so that was possible. Otherwise we have to send in a copy of the new I-140 to join the I-485 when one's PD is current. I am waiting for copy of the I-140 to follow up on I-485 with SR and Infopass.

My AP was approved last week (Monday) still to get in mail.
Seems like AP takes a longer route to the mail box in USCIS... Mine is at NSC and my experience is that everything out of there is slower...
Anyways I am greatful that they approved it and its in mail ( fingers crossed )

I have applied for my I485 last month and received receipt numbers this week. At the time I consulted my company lawyer and he said it is possible apply from your wife's company for both of us and when USCIS gets to approving one application they will ask other one to be withdrawn.
The reason I asked and agreed to do so was manily because of the VERY unstable condition our my job. My wife's job is more stable than mine.
Now we are try to apply from my wife's company, her lawyer is saying that we can not have more than one I485 pending, had I known this - it more based on interpretation from the lawyers I would not have applied for my application just applied for my wife's.
Hoping that nothing may happen should I drop the idea of applying for I485 from my wife's company. Although my hope line is too thin.

Yes, immigration officers at field offices do not have knowledge of what happened on July 2nd. Even today when I atteneded Infopass, I tried to remind the story by saying July 2nd event and she had no clue what happend on that date.

I got the RFE on my I485(PD:May 2002 - India- EB3- I140 approved on jan-2009) application. The query is,
The birth certificate you submitted has a delayed registration. Please comply with the following.
a) Hospital birth records which name the child and both parents.
b) Medical records which name the child and both parents
c)school records which name the child and bother parents.
d) Census records which name the child and both parents.
c) Religious records in the form of a certificate under the seal of the organization where the baptism, dedication, presentation or comparable e rite occurred following the birth,showing the date and place of the child's birth, the date of the religious ceremony, and the name of the child's parents.
I have the transfer certificate and the mark statements that has the father's name, my name and the date of birth. In general, schools and colleges in india, don't include the mother's name. Also i born at home, i don't have any hospital birth records and medical records. I am totally confused what records i need to provide to USCIS. I discussed some famous attorney, they too encouraging me to get any form of documents with my mother name back home in india. Any advice is greatly appreciated. I still haven't received my Green card. Realistically, I can expect only in 2017, a solid 14 years after my initial filing. In my profession, technology chances at a rapid pace and 14 years is like several decades. Also, the economy would have several boom and bust cycles during those 14 years. Recession itself is very bad but a legal employment based immigrant goes through a "recession with severe restrictions"....
One has to live through it to understand it...In all this, one thing that keeps me awake is my strong desire to provide a better life for my children and to realize my version of the American dream."

Sofar(End of day 03/13/2010) My Employer have not received the receipt no from vermont Service Center. My Employer himself took LCA and Applied H1 transfer.He sent Cashier cheque with the documents.My Employer is an American company where I have to start working once it is approved.
Please help me regarding this.

Approximately the same. My lawyer filed paper based for me and I e-filed for my wife around the same time , they came within 1 weeks of each other ( don't remember which came first ) , the only thing is , for e-filed EADs, you have to go to the nearest USCIS office for a biometrics , while paper based EADs have the pictures with the application.

I may have to use it for work from January as I am invoking AC21. I am confused now whether to re-apply or just use it like as it is.
My attorney informed USCIS about the typo error when they received the AOS receipts , but it looks like EAD Card was ordered before USCIS was notified. My Advance Parole has also mis-spelled Lastname. I have USCIS letter confirming typo error attached to my case. Would this be a sufficient proof that my EAD has a different Lastname which is only a typo error?
Gurus please advise.

Once you apply for I-485, you are in "adjustment of status" - an intermediate status. No H4 is required. However, you can work only if you have a work visa or EAD. In case of a student, if you have OPT, you are ok to work.
Thank you for your response, I appreciate it. Unfortunately, there is not OPT in this case.
Due to the large number of cases to be received by the USCIS, it is just anybody's guess when these documents will be available, hence my question.
My next question is, if one applies for H1 (cap exempt) for spouse, while the EAD is pending, is that allowed? I doubt if anybody had to do this, but it may be something to consider going forward.

Keep up the good work, its important that we get the message urgently to the different senate offices given that Senator Frist indeeds to have one of the Comprehensive Immigration bills debated on the senate floor starting this coming Monday (March 27th)

Don't worry about it. Infact I had 3 different numbers..one for EAD on F1, 140 and 485.
The 485 and EAD (GC based) had the same number. When ever I had to apply for AP or EAD (did only once as I always had H1), I used the one on 485 receipt as this is what I have on my GC.
I was under the impression that I will have only one A#... apparently I was wrong :)..many people said go take an infopass, get it consolidated etc.. I think this will mess up things than clearing it going by their efficiency.
Forget about the one on 140....always use what they gave you on 485 receipt... leave the consolidation part to them.

Other option is to get Personal Line of Credit from a local credit union or bank.
With good credit score it is possible to get line up to 25K.
Interest rate is high, around 8.75% to 11.00%..

If the intent is only to study, then she can pursue on H4 it self. And there are advantages to that.
1. She can be under registered (as a full time student on F1 she must register for 12 credit hrs each sem. She will be out of status if she couldn't get a class or if a class is cancelled).
2. Most of the univs. charge in state fee if the student is on H4 and has been in that state for more than an year. Therefore, the fee expenditure will be reduced by say 4 times
3. Change to F1 in the last sem. and that makes her eligible for OPT.
