I am in a confused situation, any thoughts / guidelines are greatly appreciated..
The question is : If my h1 is with company A and my GC is applied for future employment by company B, can I use EAD to take up full time employment with company C (or Self) ?
The full story is : The client company, I am working with is processing my GC for future employment. 485 was applied and I received EAD. It has come up that the current employer has an agreement with the client that , the client should not employ any of their employees for 1 yr after the termination. So, I need to quit the current employment, work else where for a year and then join the GC sponsering company.The I140 will not be revoked.
Since I am not currently working for GC sponsring company, does any of the AC21 issues matter ?

yes you can take up employment with C. If you get an RFE at any point within the next 180 days make sure B can give you an employment offer letter. post 180 days you can invoke AC-21 if you want and use C as your GC-Sponsoring employer.

If you will be getting any benefit in the volunteer position, such as experience in your profession, contacts, or other vocational benefits, I would not consider it appropriate H-4 activities. Even if you are not being paid a salary, you are getting a professional benefit and that is a reward.

At a recent AILA Conference, Michael Ayetes (USCIS Associate Director, Operations) announced, that during the months of July - August 2007, USCIS had received approximately 800,000 employment based adjustment applications (I-485s): 40,000 concurrently filed with I-140 petitions, 320,000 stand alone applications, and 400,000 dependent applications.
Of the 140,000 annual employment-based immigrant visas available, second and third preference categories are allocated 57.2%. If most of the employment based cases filed in July-August 2007 were second and third preferences, it could take approximately ten years of allocation to complete all these cases.
Although USCIS has posted on its website that I-485 cases received on or before August 9, 2007 have been entered into the system, a number of attorneys have not yet received receipt notices for cases filed at the end of June and July 2007. Moreover, some cases initially filed in Nebraska and transferred to Texas have now been forwarded to the Vermont or California Service Centers for faster processing of receipts.
USCIS is making every effort to process EAD applications within 90 days of receipt. The processing of Advance Parole applications may be delayed due to the number of cases filed.
A Biometrics notice will be issued even if a visa number is not available at the time.

Here, actually, I'm applying for change of status & not extension. Should I write N/A or the I-94 expiry date of my spouse's H1 petition?

I am from North Carolina and I am applying for ITIN for my wife along with 1040.
I understand I need to send 1040 & ITIN to the ITIN address:
Internal Revenue Service
ITIN Operation
P.O. Box 149342
Austin, TX 78714-9342
Being from NC, the mailing address for my 1040 is:
Internal Revenue Service Center
Atlanta, GA 39901-0002
I should be using ONLY the ITIN address for my this year's tax return and not the address for Atlanta, GA. Am I correct?
Once IRS send me the ITIN for my wife in 4-6 weeks, I should use that to submit my state return (where I am getting a refund). The state return would happen only after the deadline of Apr 17 because its only then that I shall get an ITIN for my wife.
Please advise.

Anybody filed your H1 ext yourself? Is it worth it?
This will be my 12th yr extension. I have the previous extension papers (copies) that the lawyer sent me, so i was thinking i can look at those and draft a new ext myself. But with the latest news of H1 denied for consulting companies, is it worth doing it myself? I have worked for the same client for the last 11 yrs.
Everybody else would also like to do the same thing. Instead of Paying 3500 dollars to the attorney plus other fees by the employer. I feel its good to do it by yourself. If you have anything wrong USCIS would contact you back and you can reply on those. if it becomes a major thing, then you can hire a attorney.
I feel someone should post all the steps to file
1. H1B transfer
2. EAD
3. AP
4. I-485 (As for EB-I it would take a long time)
5. All other forms
Its not worth paying the attorneys for such a long time. Let USCIS take the trouble of correcting our errors

Thanks, it doesnt generate an error so it should be alright. The panel still doesnt appear so I created it with asp:

Dates are valid as of November 30, 2008. Texas is processing July 11, 2007 applications. Looks good. It means CIS finally has time to work on the deluge of applications they received in July 2007, even though the dates are not current yet. The approvals may still be far off, but at least we know that our apps are being worked upon.
