No, only allows people on H4 for more than 6 years to get a H1B of their own for 6 years or until their spouses EAD/GC's arrive.

Lou has branded an entire national communiy in his hate filled rhetoric. I appreciate that good people differ in their views on immigration, but this crosses the line. H1b is "cheap Indian labor" and "overstay their visas" ??
Lou believes in quoting no facts, just bullishly repeating such views. Nobody who disagrees can ever get a word in. I am a specialist physician with multiple degrees and board certifications. I practice in underserved communities, speak fluent English and pay my taxes. My visa status is and always has been legal. Do I meet the Lou standards? I am waiting in an endless line for a green card that keeps me at the bottom based on my country of birth. So much for Lou's cheap labor! Has everyone forgotten his tacit support for outsourcing in his "other professional life"?

Thanks to every person who answered this post. I managed to get an appointment in mumbai for Aug 2nd. This will give enough time to send necessary document from my end and also give enough breathing to file the application.

I think they might have thought that Grassley is like our Indian MPs and why should reply to him. They should have answered responsibly and tried to do some good faith efforts. Now it is paying time for their arrogance. Still Indian companies and Bodyshoppers are having time to change themselves. We need to wait and see whether they will change and forced to change.

If I was on the receivng end of that response; I would have thought that these guys are playing with me and by not answering the quesitons; then they are obviously trying to hide something. Therefore, I will attack them in another way to make them conform to the behaviour I want.

question 1) did both you and your spouse's I485 cases receive the "pending at the location it was transfered to"?
question 2) did both you and your spouses I485 cases receive RFE?
question 3) did both you and your spouses case have an LUD after RFE?
have you guys received the RFE notices and if yes, what is USCIS asking

LUD for my wife before RFE. RFE on just mine. got 1HLUD and 3 SLUDs on just mine after RFE received, no transfer on both cases

From what I gathered, you were just being a messenger and if you look at my post, I have never referred to you in anything. All my answers were directed to hadron. At the same time its a little frustrating to us when people repeatedly keep on questioning our goals/legitimacy. Being a messenger, you bore the brunt from some of us :(

If they don't want to publish the numbers, fine. If they don't want to process application, we can't do anything about it. But at least move the PD forward so more cases become eligible for approval and it makes USCIS's life easy to use all the numbers.
Whats the use if they move PD forward by 2 years in July and then USCIS is super busy using all the numbers available. It would be better if DOS move PD forward every quarter if they see visa numbers are not utilitized.
They should divide 140K total numbers by 12 (which is 11666) and watch each month how many numbers were used in last month. If 11666 numbers were not used last month then they should move PD for retrogressed country forward so more cases become eligible.
This is not rocket science and I don't know why DOS don't understand it.

u can easily get an affadavit from someone with a business that says u worked there for a period of x days while ur h1 was with yyy company... that puts u into an illegal category too.
i m growing some tomatoes this summer....maybe i can get additional points if i grow them for 100 days every year and then after another 5 yrs i can get some more points in the new merit based system

He sent me an email to pay $3500, do you think he will go legal for this, I did not sign any contract with him.
If he goes to court will i loose(he may create documents) or will i be in trouble if he wins the case.
Please suggest.

I don't think anybody will tell you for sure what the court will rule. Even if you pay a lawyer he will not tell you that - not in writing. Chances are that this will not even go to court and based the discussion on this thread its very unlikely if this will hold in any court.
BTW, how did he come up with the figure 3500? Is that the salary that was paid to you while you were working for another company? As somebody pointed out earlier if this was the money paid to you as compensation when you did not work for him then he might be reasonable in asking you to re-pay.

I think desi3933 is correct. It is the employees responsibility to maintain the status and all the employee can do is to sue the employer for the pay. Even I am not sure about 30 day rule, but employee should be getting payed on H1B. Also it may only be necessary to prove the legal status since the last entry.
