Thanks SOP!
Thats a good suggestion. I will contact the congressman and senator and ombudsman as well.
How can they reopen a case thats already approved. They approved and reopened the case on the same day.
We took infopass and they told us that the visa's retrogressed so they had to pull back their decision. I showed the officier visa bulletin and told him that am current as today is oct 1st and the new qouta should have started already.
The response he gave is he cann't access the files as the files are frozen and it will take them about 2weeks to access the files.
My files are at local office as i had an interview on Aug 24th

If you do not receive a decision or other notice of action from us within 60 days from the date of this letter, please contact customer service to complete another service request

I would appreciate if someone can interpret the message.

that's is how my attorney sent it to me. I just looked at my record copy and answering such questions like this.
By the way fellow IVans, don't forget to keep one copy of every thing (of course NOT the sealed cover)of AOS, EAD, AP filing for your records and future reference. Friday evn. after 3.00 PM is a good time at your office copier. Don't use - Automatic Document feeder (whatever thay call it - you pile your papers on top and press button); do it the hard way. One paper after another.
Don't comeback and CRY that you Original Approval Notice or I-94 or BC or something like that was stuck in the copier and now damaged.
In the section 11 of the document what should be the text incase you are supporting your spouse and child @100%
Appreciate your help

I don't want to be a spoilsport.
But there is a possibility that EB2I has not yet retrogressed (inspite of heavy porting) because USCIS knows EB1C 12000 will flow to EB2 right. In that case we may not see movement of dates in par with 12000 spillover.
Maybe I am pessimistic.
In all calculations, it is mentioned that porting at max could be 6k/year. How did we come up with this number? Any proof or just a guess?
Thanks.
This is a very simple calculation. Following are the numbers before Oct -2006. These total to ~ 12K.
EB2-C - 3521
EB2-I - 9345
The dates will move further if more than 12K numbers are infused into the system. I would say that the dates should be in Oct - Nov 2006 range with these 12K numbers, having Nov as buffer as they may issue RFE's to folks.

Guys,
Please don't be afraid to share your denial info. At this time, OMB is asking to remove all personally identifiable information from reciept notices. So, we don't have to worry. We will get much attention only with specific evidances. Please do not hesitate..
I have recieved Omb response since I partificipated in the campaign. But, I have not used AC21 yet. Will be contacting PD_Recap for further direction.

Hi,
I went for my medical exam this week. My shot record has one entry for DTP (10 year booster) which I took earlier this month. I used to take this vaccine as a child regularly (back then it used to be valid for 6 months), but I have no written evidence of it.
Anyway, in the spplumental form to I-693, the doctor I visited checked the "Not appropriate age" in the first row for DT/DTP. In the second row for Td, the doctor filled out the Date Rec'd column from my shot record but also checked "Insufficient time interval". When I asked the doctor about this, he said that it will be "alright". Is this going to be ok with USCIS? Or do I have to demand the doctor to do a Titer for Tetanus and Diptheria to prove I have immunity for it?
Regards.

If USCIS is providing spillover visas to EB2 in May, shouldn't the PDs of China and India (countries with most demand) have the same PDs in May VB? Doesn't this also mean that in the worst case the PD of EB2 India will be Jul 22 2006 (the current PD of China) in May VB?

All,
Lingo came up with the same plan....here is the link below....
https://www.lingo.com/shop/promotions/helloworldmax.jsp
I am not sure how to navigate from LINGO.COM, but the link gives the info...share if any body has exp. with this company....
2 years aggreement. 5000 mins with the below condition (from Terms & Conditions)
Lingos advertised rates for international calls are generally the rates charged for calls to landline telephones. Some calls to international mobile telephones, or to international telephone numbers considered to be special services calls, are charged a different (usually higher) rate than calls to landline telephones. The rates you will be charged are set forth in the calling plan rate tables and are typically designated by a "MOB", "cellular", "mobile" or "M" notation.
Not sure if this applies to the new plan.

(COMMERCIAL BREAK) DOBBS: The Senate's grand compromise could dramatically increase the number of H1-B visas from 65,000 to 180,000. It would also expand the number of exemptions to those limits. It's a bill that favors, by a wide margin, corporate America and further -- further disadvantages American workers.
Bill Tucker has our report.
(BEGIN VIDEOTAPE)
BILL TUCKER, CNN CORRESPONDENT (voice-over): All H1-B visa workers do not look like this. Some even look like this. Most do work at technology companies, based on the latest data available from the government, data which is incomplete but revealing, nonetheless.
Five of the top six employers of H1-B visa workers in 2006 were Indian companies. They were issued 18,453 visas. In total, almost 20,000 visas issued in 2006 went to Indian outsourcing companies, and the data shows it was not American workers who benefited but foreign workers.
JOHN MIANO, ATTORNEY: According to the Bureau of Labor Statistics, between 2000 and 2005, the United States' employment for computer workers grew by about 332,000.
During the same time period, the United States imported about 330,000 H1-B workers for computer occupations.
TUCKER: The situation for engineers was even worse, with 95,000 H1-B visas issued in the same period for engineering, yet according to the Department of Labor, engineering jobs shrank by almost 124,000 jobs.
The visa is often referred to as being for the brightest and the best. But, the visa is broken up into four levels of classifications, with levels 1 and 2 being the lowest-skilled positions, and 87 percent of the visas went to those categories. WTF is he talking about 1 and 2? how can bachelors required masters required be lowest skilled positions?
RON HIRA, ROCHESTER INSTITUTE OF TECHNOLOGY: We really don't know whether those workers are working at level one. We know that they're being paid level one wages.
And what's interesting, at level one is if you look at the description of it, it's basically for interns, for people who have zero experience. From what I know H1 cannot be granted with Zero experience Am i missing something????
TUCKER: No one knows how many H1-B workers there are currently in the country or where they are.Each and every one is traceable based on employers address, again fudging the facts
DOBBS: ... have gone by before providing even the summary information.
But to just put this in some perspective, what we're really reporting here is that the H1-B visa program, which by the way, we should point out Bill Gates, the world's wealthiest man, who is not exactly without a stake in this issue, sat before Senator Kennedy in a one-man hearing and said he wants unlimited visas.
The fact is we don't know who has the visas. you know that there are 330k visa issued, this itself means that USCIS knows who has the visas
We do know that Indian companies who are outsourcing the -- to American companies rather than providing the American jobs are the principle beneficiaries of those, and that most of those jobs are low-skill jobs, are being paid at intern levels.Again fudging the facts, everyone has to be paid prevailing wages
I guess we should say in the case of category one. How in the world can the United States Congress, with this information in front of all of us, sit there or stand there on the Senate floor with straight faces and talk about this issue without any basis for their positions?
TUCKER: I guess they're just blinded by the corporate donations, Lou. Money from the high-tech companies is the only answer I can think of.
DOBBS: The American worker. And where is AFL-CIO? Where in the world are all the labor organizations in this country, who should be standing up and demanding that the American worker not lose his and her rights that have been so hard fought for and won over the course of the past century? It is mind-boggling to me.His final notes or propaganda after fudging the facts to provoke and anger citizens who just saw the bs report
Bill Tucker, thank you very much.
And we'll continue to put the facts before not only this audience but even the recalcitrant legislators who represent us all in Washington, D.C.

This is approx data from last year DOS yearly report.
EB1 = 41k
EB2 = 53k
EB3 = 42k
EB4 = 11k
EB5 = 2k
Total was ~ 150 k ( 140k + 10 K from Family Quota's Spill over )
so basically EB1 and EB2 row didn't give any spill over , it was EB5 and family based spill over.
This year we will not get family but instead EB1 will give same share so in the end total spill over for year will not be more than 20-22k.

That suit will not stand a chance, not becasue it doesn't have legal merit but because it goes to the core of capitalistic system. Coporations can choose to hire and fire anyone as long as they don't fundamentally descriminate in writing. All of us know, that employers and hiring manangers have their preferences that might actually border legal descrimination so this is not an immigration issue as I see it. This is a broader issue linked to the power vested to the corporations in a capitalistic society, I have seen ethnic bias, age bias and all other kind of non-sense in hiring. Anyone claming that this doesn't happen or this is an immigration issue is simply in denial. It is just the way of life. As BharatPremi has pointed out, law says descrimination in the documents after hiring is illegal but it doesn't say that employer cannot choose to hire anyone as suited. Equal opportunity hiring practices are just guidelines which says job requirements MUST be uniformly and consistently applied to all race and color. It doesn't say you cannot choose to have an all white or all black work force. Unfortunately there is no law that clearly prohibits descrimination based on visa status (at least I am not aware of one). In fact the legal pressure is just for the opposite, that puts additional burden on the companies to make effort in hiring local workers first. The corporation can always say they have a policy to not hire someone with temporary work permit and there is no law against it. It is sad but that's how it is.
Using the same logic, they can avoid interviewing an African American.
I think we all should get together and file a class action law suit against those companies.
