    Indeed I would hate to live under such a system...
    but, I do think that it is worth reminding kids who smugly proclaim that they are involved in illegal activities because of skewed morals and misguided self-entitlement that there are penalties and consequences for such actions... don't you?

    You are correct that the way it is setup we pay for access and it has limitations and restrictions. I think the point is this just feels wrong. We have to accept it in the USA because we don't have a lot of choice/options. But in general if I am paying for data then why can't I just use it on what ever device I want? It doesn't make sense from a consumer stand point aside from the fact if you want data (which you are forced to pay for if you get a smart phone) then you have to agree to the wireless company terms.

    From their stand point, I think it is done to limit access while they build out the system. Watch though, once things get built out competition will come in and you will see data $$$ and limitations drop like minutes.

    I don't know, but it seems you guys are paying way more than what I am paying here in Hong Kong.

    Around $50 USD per month, it comes with 3900 minutes voice + unlimited data and free to use on tethering. And we are talking about the speed like this:

    I'm really tired of hearing this. First of all, people are not forced to buy from the iTMS, CDs still exist.

    Second, the songs can be played on a Mac computer with iTunes, a Windows computer with iTunes, iPods. They can also be burned to an audio CD which can be played on millions of devices.

    How is that "iPod-only"?! :confused:

    To use on other devices requires you to have to go through a lot of unnecessary and time consuming hoops.

    DRM should be unified - one DRM standard for ALL devices.

    I don't know why Google is bothering. The Amazon cloud system *should be*/is great and competition enough for iTunes - both in terms of pricing (certainly) and usability (more debatable).

    The fact that Android doesn't need an iTunes-esque system to compete with Apple means that they should probably give it up now.

    Note: For the fanboys out there, please don't get too excited by this. Amazon's cloud is going to present new and interesting challenges for Apple, I don't think Google's failure to negotiate with the jumped up music industry is necessarily a bad thing, all things considered!

    You do know that Windows had an App Store before OS X, but it got axed due to it being badly implemented which resulted in lack of custom? All they are doing there is returning and improving one of their own features, not copying Apple.

    If we consider only games, Microsoft's own game store has been running since December 2009. Games for Windows LIVE Marketplace.

    That is so crazy it's ridiculous. There is no evidence to support your statement. Mac OS X is not headed towards the "walled garden" universe that everyone seems to freak out over. Apple's just giving people who don't know anything about computers an easy way to purchase and find applications.

    I do agree, however, that by not including applications outside of the Mac App Store Apple is diminishing the value of the award. I believe it is within their right to do so, although I don't like it.

    I honestly wouldn't put it past Jobs. I really believe he wants the Mac to be a walled garden just like iOS.

    I went into my local Apple store yesterday and they denied that there were even upgrades? WTF? I guess they want to sell off there current stock?

    From all the reports I've seen so far, no one at Apple knows for sure what they are selling.
    Here's another report posted at Apple's Monitor forum dated August 10.

    I spoke with Apple today to determine what the deal was with the recently upgraded brightness and contrast specs for the 20" and 23" Cinema Displays. They indicated that the change was actually (quietly?) made back in April and that any monitor recently sold directly by Apple should be one of the newer models.

    Although the data transferred may be the same or more with on-demand streams, when it's live there will be much higher simultaneous usage. With high-end hosting in general, simultaneous usage is the killer and not really total bandwidth usage. With the popularity of Apple these days the number of simultaneous streams could be extremely high (I mean, if MacRumors gets 100,000 visitors simultaneously think what Apple would get themselves).

    I don't think expense is the issue here.

    Apple can either:

    1. Offer the stream only to the stores

    2. Pay for massive bandwidth. Have you seen the profit from last quarter alone?! The people watching would most probably have bought an apple product of 5 recently!

    Apple Gets French Support in Music Compatibility Case

    PARIS, July 28 � The French constitutional council, the country�s highest judicial body, has declared major aspects of the so-called iPod law unconstitutional, undermining some controversial aspects of the legislation.

    � Apple�s lawyers might want to drink a glass of French Champagne today, but not a whole bottle,� said Dominique Menard, partner at the Lovells law firm and a specialist in intellectual property. �The constitutional council has highlighted fundamental protections for intellectual property in such a way as to put iTunes a little further from risk of the French law.�

    Released late Thursday, the council�s 12-page legal finding made frequent reference to the 1789 Declaration on Human Rights and concluded that the law violated the constitutional protections of property.

    The decision affects Apple�s market-dominant iTunes Music Store by undermining the government�s original intention, which was to force Apple and others to sell music online that would be playable on any device. Apple�s iPod is the only portable music device that can play music purchased on iTunes, which lead rivals to complain about anti-competitive practices.

    Although the ruling could still require companies like Apple to make music sold online to be compatible with other hand-held devices, it said that the companies could not be forced to do so without receiving compensation. The council also eliminated reduced fines for file sharing.

    �The constitutional council effectively highlighted the importance of intellectual property rights,� Mr. Menard said, emphasizing that Apple and other companies must be paid for sharing their copy-protection technology.

    The law, which had been approved by the French Senate and National Assembly last month, was brought for review at the demand of more than 100 members of the National Assembly. The council�s review of whether the law fits within the French Constitution�s framework is one of the final steps before a law is promulgated. It now could take effect as altered by the council or the government could bring it once more before the Parliament.

    The French minister of culture, Renaud Donnedieu de Vabres, advocated enforced interoperability as a way to ensure diverse cultural offerings on the Internet by limiting technical constraints on digital works.

    While the constitutional council highlighted the need for compensation, it was not such good news for Apple and other companies that the principle of forced interoperability remained in place, said Jean-Baptiste Soufron, legal director of the Association of Audionautes, a group opposed to copy restrictions.

    it's a shame the whole "antennagate" fiasco gave the iPhone 4 such a bad rep. I've had mine since launch, and I have had roughly 5 dropped calls. 3 of which happened while I was in a moving vehicle. So it could just as easily be blamed on the network or the place I was driving through at the time.

    It seems like whenever someone wants to knock the iPhone they go straight for the antenna non-issue.

    Nah, the guy who used to rent the house used to pawn a lot of stuff. The address was on file with several pawn shops in the area as his residence.
